Ricky Gaters’ case is complex and multifaceted. He was apprehended in North Portland on the evening of a gang-related shooting. Police found him near the scene. When they stopped to question him, he resisted arrest. He was intoxicated at the time; police also alleged that he had marijuana and ammunition on his person. The caliber of the rounds matched the ammunition used in the shooting. Following his incarceration, he took a plea deal that reduced his sentence from 20 years to 10.
Ricky’s defense team is seeking a post-conviction relief, alleging that the eyewitness account misidentified him. Moreover, there is a question about whether Ricky was Mirandized at the time of his apprehension. The officers’ ‘excessive use of force’ is also a factor in the relief request. And finally, the bullets found on Ricky were never batch-tested to determine an accurate match to the rounds used in the shooting - although the calibers did match.
